制止牟取暴利的暂行规定
Interim Measures concerning Curbing the Making of Exorbitant Profits

第一条 为了维护社会主义市场经济秩序，制止牟取暴利，保护消费者的合法权益，制定本规定。
Article 1 In order to safeguard the order of the socialist market economy, curb the making of exorbitant profits, and protect the lawful rights and interests of consumers, these Measures are hereby formulated.

第二条 本规定适用于对国民经济和社会发展有重大影响的和与居民生活有密切关系的商品和服务（以下简称商品和服务）。
Article 2 These Measures shall apply to the commodities and services which have great impact on the national economy and social development and have a close relationship to the residents' lives (hereinafter referred to as the "commodities and services").
前款规定的商品和服务的项目，由国务院价格主管部门按照国务院的有关规定公布、调整；其中实行国家定价的，按照国家定价和国务院有关价格管理的规定执行。 The department in charge of price under the State Council shall, according to the relevant provisions stipulated by the State Council, publish and adjust the items of commodity and service specified in the preceding paragraph published and adjusted by; those whose prices are fixed by the State, shall be implemented according to State fixed prices and the provisions stipulated by the State Council on price administration.
省、自治区、直辖市人民政府可以根据本地方的实际情况，在国务院价格主管部门公布的商品和服务的项目的基础上，决定适当增加与本地方居民生活有密切关系的商品和服务的项目，予以公布，并报国务院价格主管部门备案。 The people's governments of provinces, autonomous regions and municipalities directly under the Central Government, according to the actual situations in their respective regions, and on the basis of the commodity and service items published by the department in charge of price under the State Council, may, provided that a report is made to the department in charge of price under the State Council for the record, decide to appropriately increase the items of commodity and service in their respective regions that have a close relationship to the residents' lives., publish them accordingly.

第三条 在中华人民共和国境内从事生产经营和提供有偿服务的公民、法人和其他组织（以下简称生产经营者）必须遵守本规定。
Article 3 The citizens, legal persons and other organizations engaging in production, operation and provision of compensated services within the territory of the People's Republic of China (hereinafter referred to as the "producers and operators") shall conform to these Measures.

第四条 生产经营者的价格行为应当遵循公开、公平和诚实信用的原则，执行国家关于商品和服务实行明码标价的规定。
Article 4 The producers and operators shall, in their acts relating to prices, abide by the principles of openness, fairness and good faith and implement the provisions of the State which specifies that prices of commodities and services shall be clearly marked.

第五条 商品的价格和服务的收费标准（以下统称价格），应当符合下列要求。
Article 5 The prices of commodities and the standards for charging for services (hereinafter jointly referred to as the "price") shall comply with the following requirements:
（一）某一商品或者服务的价格水平不超过同一地区、同一期间、同一档次、同种商品或者服务的市场平均价格的合理幅度； (1) The price level of a certain commodity or service shall not exceed the reasonable range of the average market price of the same kind of commodity or service, of the same classification, during the same period of time and in the same area;
（二）某一商品或者服务的差价率不超过同一地区、同一期间、同一档次、同种商品或者服务的平均差价率的合理幅度； (2) The price differential of a certain commodity or service shall not exceed the reasonable range of the average price differential of the same kind of commodity or service, of the same classification, during the same period of time and in the same area; and
（三）某一商品或者服务的利润率不超过同一地区、同一期间、同一档次、同种商品或者服务的平均利润率的合理幅度。 (3) The profit margin of a certain commodity or service shall not exceed the reasonable range of the average profit margin of the same kind of commodity or service, of the same classification, during the same period of time and in the same area;
但是，生产经营者通过改善经营管理，运用新技术，降低成本，提高效益而实现的利润率除外。 however, the profit margin achieved by producers and operators through improved operations and management, application of new technology, reductions in costs or an increase in efficiency shall be excepted.

第六条 商品或者服务的市场平均价格、平均差价率、平均利润率以其社会平均成本为基础测定。
Article 6 The average market price, average price differential and average profit margin of the commodities or services shall be determined according to their average cost in society.
商品或者服务的市场平均价格、平均差价率、平均利润率的合理幅度，按照其与国民经济和社会发展的关系或者与居民生活的密切程度，市场供求状况和不同行业、不同环节、不同商品或者服务的特点规定。 The reasonable range of the average market price, average price differential and average profit margin of the commodities and services shall be specified pursuant to their relationship to the national economy and social development or the closeness of their relationship to residents' lives, the circumstances of market demand and supply and the special characteristics of different commodities or services at different stages and in different industries.

第七条 商品和服务的市场平均价格、平均差价率、平均利润率及其合理幅度，由省、自治区、直辖市的人民政府价格管理部门会同有关业务主管部门，按照国务院价格主管部门的规定测定和规定，并予以公布；
Article 7 The average market price, average price differential, average profit margin, and their reasonable range, of the commodities and services shall be determined, specified and also published by the price administration departments of the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government in association with the relevant competent departments of industries pursuant to the provisions stipulated by the competent price department of the State Council;
省、自治区、直辖市人民政府价格管理部门也可以根据需要，授权市、县人民政府价格管理部门测定和规定与居民生活有密切关系的部分商品和服务的市场平均价格、平均差价率、平均利润率及其合理幅度，并予以公布。 the price administration departments of the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government may also, pursuant to the needs, authorize the price administration departments of the people's governments of the cities or counties to determine and specify the average market price, average price differential, average profit margin and their reasonable range, of that segment of commodities and services which have close relationship to residents' lives, and publish them accordingly.
有关业务主管部门和生产经营者应当配合价格管理部门的测定工作。 The relevant competent departments of industries and the producers and operators shall offer assistance in the assessment work of the price administration departments.

第八条 生产经营者不得违反本规定，以下列手段非法牟利：
Article 8 Producers and operators shall not, in violation of these Measures, illegally make profits by the following means:
（一）不按照规定明码标价或者在明码标示的价格之外索要高价； (1) Failing to have prices clearly marked pursuant to the provisions or demanding prices beyond the prices marked;
（二）谎称削价让利，或者以虚假的优惠价、折扣价、处理价、最低价以及其他虚假的价格信息，进行价格欺诈； (2) Lying about cutting prices and giving profits, or engaging in price cheating through false preferential pricing, discount pricing, clearance pricing, the lowest price and other false price information;
（三）生产经营者之间或者行业组织之间相互串通，哄抬价格； (3) Driving up prices by collusion among producers and operators or between trade organizations;
（四）违反公平、自愿原则，强迫交易对方接受高价； (4) Forcing the other party in the transaction to accept a high price in violation of the principles of fairness and voluntaries; and
（五）采取其他价格欺诈手段。 (5) Using other methods of price cheating.

第九条 价格监督检查人员依法执行职务，生产经营者不得拒绝、阻碍。
Article 9 Producers and operators shall neither refuse nor obstruct price supervisors and inspectors from fulfilling their duties pursuant to law.

第十条 对生产经营者牟取暴利的行为，任何单位和个人都有权向价格监督检查机构投诉或者举报。
Article 10 As for any behavior of producers and operators in making exorbitant profits, any unit and individual shall enjoy the right to lodge a complaint with or make a report to the price supervision and inspection agencies against it.
价格监督检查机构受理投诉或者收到举报后，应当及时调查核实情况，依照本规定予以处理，并根据情况对举报者给予奖励。 After accepting a complaint or receiving a report, the price supervision and inspection agency shall promptly investigate and verify the facts, deal with the case pursuant to these Measures, and give an award to those making the reports depending on circumstances.

第十一条 违反本规定
第五条规定的，由价格监督检查机构责令改正；
Article 11 Anyone who are in violation of the provisions of
Article 5 stipulated in these Measures shall be ordered by the price supervision and inspection agencies to make corrections;
拒不改正的，予以警告、没收违法所得，可以并处违法所得５倍以下的罚款。 anyone who refuses to make corrections shall be given a warning, have the unlawful gains confiscated and also may be imposed a fine of not more than 5 times the amount of the unlawful gains.

第十二条 违反本规定
第八条规定的，由价格监督检查机构予以警告，责令其向遭受损害的一方退还违法所得，违法所得不能退还的，予以没收，可以并处违法所得５倍以下的罚款；
Article 12 Anyone who are in violation of the provisions of
Article 8 of these Measures shall be given a warning by the price supervision and inspection agencies, ordered to refund the unlawful gains to the party suffering loss; if unable to be refunded, the unlawful income shall be confiscated and a fine of not more than 5 times the amount of the unlawful gains may be imposed;
情节严重，构成犯罪的，依法追究刑事责任。 if the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated into pursuant to law.

第十三条 以暴力、威胁方法阻碍价格监督检查人员依法执行职务的，依法追究刑事责任：拒绝、阻碍价格监督检查人员依法执行职务，未使用暴力、威胁方法的，由公安机关依照治安管理处罚条例的有关规定处罚。
Article 13 Anyone who obstructs, by way of violence or threats, the price supervisors and inspectors from fulfilling their duties pursuant to law, shall be investigated into criminal responsibility pursuant to law; anyone who refuses or obstructs the price supervisors and inspectors from fulfilling their duties pursuant to law without using violence or threats, shall be subject to punishment by the public security organs pursuant to the relevant provisions stipulated in the Regulations on Administrative Penalties for Public Security.

第十四条 价格监督检查人员玩忽职守、徇私舞弊，或者包庇、纵容牟取暴利的行为的，依法给予行政处分；构成犯罪的，依法追究刑事责任。
Article 14 Any price supervisor or inspector who neglects his duties, commits irregularities for personal interests or by fraudulent means or shields or winks at any act of making exorbitant profits, shall be subject to administrative sanctions pursuant to law or investigation into criminal responsibility pursuant to law if a crime is constituted.

第十五条 工商行政管理、审计、财政、税务、公安、技术监督等部门，应当在各自的职责范围内，配合价格监督检查机构查处牟取暴利的行为。
Article 15 The departments of administration of industry and commerce, auditing, finance, taxation, public security and technology supervision shall, within the scope of their respective duties and authorities, assist the price supervision and inspection agencies in inspecting and dealing with activities of making exorbitant profits.

第十六条 省、自治区、直辖市人民政府，可以结合本地方的实际情况，根据本规定制定实施办法。
Article 16 The people's governments of provinces, autonomous regions and municipalities directly under the Central Government may, according to the actual conditions in their respective regions, issue implementing rules pursuant to these Measures.

第十七条 本规定由国务院价格主管部门组织实施。
Article 17 The implementation of these Measures shall be effected under the organization of the department in charge of price under the State Council.

第十八条 本规定自发布之日起施行。
Article 18 These Measures shall be implemented as of the date of promulgation.
